Introduction

Shin Nihon Kosan Inc. (d.b.a. Shogun Restaurant), together with its U.S. subsidiaries and affiliates that provide services under the name "Shogun Restaurant" ("Company", "we", "our", or "us") respect your privacy and are committed to protecting it in accordance with this policy. This policy describes how we collect, process, retain, and disclose personal data about you when you use our websites, newsletters, restaurants, or otherwise communicate with us (collectively, the "Services") and our practices for using, maintaining, protecting, and disclosing that information.

This policy applies to information we collect:

  • Through the Services.
  • In communications, including email, text, chat, and other electronic messages, between you and the Services.
  • When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.

Please read this policy carefully to understand our policies and practices regarding your information and how we treat it. By interacting with our Services or providing us with your information, you agree to the collection, use, and sharing of your information as described in this privacy policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of the Services after we make changes as described here is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Children's and Minors' Data

Our Services are not intended for, and we do not knowingly collect any personal data from, children under the age of 13. In some cases, a parent or legal guardian may voluntarily provide limited information about their child, such as a first name and birthday, in connection with reservations, events, Samurai Rewards, or birthday celebrations. We only collect this information from parents or legal guardians. We collect and use such information solely for the purpose for which it was provided and do not knowingly collect personal data directly from children without parental involvement. If we learn we have collected or received personal data directly from a child under 13 years old without verification of parental consent, we will delete that information.

The types and categories of personal data we may collect or process include:

  • Contact information: including your name, email address, phone number, and other contact information you provide us.
  • Family and guest information: including their first names and birth dates, if you choose to provide it (for example, when booking a birthday party or joining Samurai Rewards).
  • Payment information: including credit card or debit card information.
  • Order history: including information about your subscription, transactions, purchases, or discounts.
  • Your preferred Shogun location.
  • Device information: including your IP address, device identifiers, operating system and version, hardware identifiers, browser type and settings, and other device information.

We also collect:

  • Statistics or aggregated information: Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from personal data. For example, we may aggregate personal data to calculate the percentage of users accessing a specific Services feature.
  • Technical information: Technical information includes information about your internet connection and usage details about your interactions with the Services, such as clickstream information to, through, and from our Services (including date and time), products that you view or search for; page response times, download errors, length of your visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), or methods used to browse away from a page.

If we combine or connect non-personal statistical or technical data with personal data so that it directly or indirectly identifies an individual, we treat the combined information as personal information.

You Provide Information to Us

We collect information about you when you interact with our Services, such as when you place an order, subscribe for our Samurai Rewards, or make a reservation, or participate in surveys, sweepstakes, contests, or promotions.

Automatically Through Our Services

As you navigate through and interact with our websites, we may use automatic data collection technologies to collect certain information about your equipment and browsing actions. This includes:

  • Usage Details & Device Information: Details of your visits to our website, including traffic data, location data, logs, and the resources that you access, as well as information about your computer and internet connection (IP address, operating system, and browser type).
  • Cookies and Tracking: We may use "cookies" (small files placed on your device) and web beacons (small pixel files) to help us improve our website, see which pages are popular, and deliver a more personalized experience. You can set your browser to refuse cookies, but some parts of our site may not function properly if you do.

Google Analytics & Targeted Advertising Technologies: We use third-party analytics and advertising technologies, such as Google Analytics, Google Ads, and Meta (Facebook and Instagram) Ads, and similar tools, to help us understand how guests use our Services and to deliver advertising that may be relevant to your interests. These technologies may use cookies, pixels, or similar tracking technologies to collect information about your interactions with our Services and with third-party websites over time. Please see Your Rights and Choices About Your Information for information on how you can opt out of behavioral tracking on this website and how we respond to web browser signals and other mechanisms that enable consumers to exercise choice about behavioral tracking.

Information from Third Parties: We may receive information about you from our service providers who help us run our business, such as Payment Processors, Reservation Platforms (e.g., OpenTable), and Email Newsletter tools (e.g., Mailgun). This helps us process your orders and provide better service. We do not purchase data from third-party data brokers.

  • Business Transfers: If our restaurants are sold, merged, or undergo a change in ownership, your information may be transferred to the new owner as part of the business assets.
  • Legal Requirements: We may disclose your information if required by law, such as responding to a court order or protecting the safety and rights of our staff and guests.
  • Aggregated Data: We may share "de-identified" or aggregated information (data that cannot be used to identify you personally) for industry analysis or local marketing research.

Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of our website (such as staying logged in or keeping items in a cart).
  • Google Analytics: To provide guests with more choice on how their data is collected by Google Analytics, Google has developed an Opt-out Browser Add-on, which is available at https://tools.google.com/dlpage/gaoptout.
  • "Do Not Track" Signals: Some browsers have "Do Not Track" features that allow you to tell websites not to track you. Our websites do not currently respond to these signals.

Links to Third Party Websites

Our websites may contain links to websites maintained by outside organizations, including third-party social networks (such as Instagram, X, Yelp). Please be aware that these third-party websites are governed by their own privacy policies. Our firm is not responsible for the content or policies maintained by these websites.
